Regulations for the provision of electronic services

INTRODUCTION
The regulations for the provision of electronic services regulates the scope and conditions of performance by KBJ S.A. with its registered office in Warsaw (01-161) St. Obozowa 57, hereinafter referred to as the "Service Provider", services provided electronically and sending commercial information.

The Regulations have been prepared in accordance with the provisions of:
Act of July 18th 2002 on the provision of electronic services (Journal of Laws of 2017, item 1219, as amended),
the general regulation on the protection of personal data (GDPR); Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC (OJ.UE.L No. 119, p. 1);
Act of July 16th, 2004 on telecommunications law (i.e. Journal of Laws of 2017, 2019, item 24601907, as amended).

  1. GENERAL PROVISIONS
    1. Definitions of terms used in the Regulations:
    • Act - Act on the provision of electronic services of July 18th, 2002 (i.e. Journal of Laws of 2020, item 344, as amended).
    • GDPR - General Data Protection Regulation - Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27th 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/ EC (OJ L 2016 No. 119)
    • ICT system - a set of cooperating IT devices and software, ensuring processing and storage, as well as sending and receiving data via telecommunications networks using a terminal device appropriate for a given type of network within the meaning of the telecommunications law.
    • Services provided electronically - services that are performed remotely (without the simultaneous presence of the parties) by sending and receiving data via ICT systems, at the individual request of the Service Recipient, with the data being transmitted via a telecommunications network within the meaning of the Act of July 16th 2004 - Telecommunications law.
    • Means of electronic communication - technical solutions, including ICT devices and software tools cooperating with them, enabling individual remote communication using data transmission between ICT systems, in particular electronic mail.
    • electronic address - designation of the ICT system enabling communication by means of electronic communication, in particular electronic mail;
    • commercial information - any information intended directly or indirectly to promote goods, services or the image of the entrepreneur;
    • Service Provider - KBJ S.A. with its registered office in Warsaw (01-161), St. Obozowa 57,
    2. The Service Provider provides electronic services at the following addresses: www.kbj.com.pl; https://www.eksf.kbj.com.pl/.
    3. By ordering the service, the Customer confirms that he has read its description, the terms of its provision and declares that he accepts all the provisions of the Regulations.
    4. Starting the service or placing an order by e-mail requires consent to comply with the Regulations and is tantamount to full acceptance of all its conditions without the need to sign an additional contract.
  2. TYPE AND SCOPE OF SERVICES PROVIDED BY ELECTRONIC MEANS
    1. The Service Provider provides electronic services, in particular:
      1. webinar on the products and services offered;
      2. industry training;
      3. newsletter
    2. The Service Provider may also provide services on the basis of separate contracts, the subject of which is the provision of electronic services.
  3. TERMS OF PROVIDING SERVICES BY ELECTRONIC MEANS
    1. The Service Provider provides services to the Customer to the extent and under the conditions set out in these Regulations or an individual offer, if it has been accepted.
    2. The Service Recipient undertakes to comply with these Regulations.
    3. The Service Provider undertakes to start providing the service within the time limit resulting from the concluded contract.
    4. The Service Provider is obliged to obtain consent for sending marketing and commercial information electronically to the electronic address of the Service Recipient.
    5. The Service Recipient is obliged to comply with the prohibition of abusing electronic means of communication and not to provide content via or to the Service Provider's ICT systems that:
      violate the rights of third parties, generally accepted social norms, are inconsistent with generally applicable laws or violate the legitimate interest of the Service Provider,
      cause disruption of the work or overloading of the ICT systems of the Service Provider or other entities directly or indirectly involved in the provision of electronic services,
    6. The Service Recipient is obliged to use the Service Provider's websites and services made available in a lawful manner, respecting personal rights and copyrights and intellectual property of the Service Provider and third parties.
    7. The Service Provider is not liable for damages caused by using the services in a manner contrary to generally applicable law, decency or otherwise inconsistent with these Regulations.
    8. Access to information, changes regarding the method and scope of services provided by the Service Provider, and to information which the Service Recipient is required to provide under Art. 6 of the Act on the provision of electronic services, will be provided by the Service Provider via the website and/or through the information provided by e-mail.
  4. TECHNICAL REQUIREMENTS NEEDED FOR USE OF SERVICES PROVIDED ELECTRONICALLY
    1. Technical requirements necessary to use the Service Provider's websites:
    a computer, laptop or other multimedia device with Internet access and a web browser supporting HTML 5;
    access to e-mail;
    enabling the option of saving Cookies and Javascript in the web browser.
  5. PRODUCT WEBINARS, INDUSTRY TRAINING
    1. The KBJ's webinar service is carried out in the form of remote interactive expert presentations.
    2. The Service Provider reserves the right to choose the questions asked during the webinar, which will be answered.
    3. The topic of the webinar, the date, duration and the presenters will be indicated each time on the website www.kbj.com.pl, https://ksf.kbj.com.pl  on the dedicated website and/or in the e-mail confirming participation.
    4. The KBJ's webinar service is free for registered participants.
    5. The number of participants in each webinar is not limited.
    6. If it is necessary to cancel a webinar due to circumstances beyond the Service Provider's control (force majeure, unavailability of the host, incorrect operation of ICT solutions and tools provided by a third party), the Service Provider will propose a separate meeting date.
    7. Participation in the webinar requires registration, including providing data, i.e. name, surname, business e-mail address, business telephone number and place of employment (or represented company/institution), optionally position or department.
    8. Both the content of the webinars, materials presented during the meeting, as well as other content made available by the Service Provider constitute legally protected content (hereinafter referred to as "Content"), to which the Service Provider is entitled. It is forbidden to distribute and make the Content available to third parties, both in the form of an original work and in the form of studies within the meaning of art. 2 of the Copyright Act.
    9. The Service Provider reserves the right to exclude and refuse access to participation in the webinar for participants who
      use the webinar in a manner inconsistent with the Regulations, the provisions of generally applicable law, violate the rights of the Service Provider, other participants or third parties, and
      • in the case of using the webinar to conduct advertising activities or in the event that the participant conducts activities competitive to the Service Provider or is a person related to the entity that conducts such activities (employees, associates, persons related by capital or personally).
    10. The webinar service is made available using ICT solutions and tools provided by an external entity, i.e. Zoom Video Communications Inc. Participation in webinars does not require installing additional software at the Service Recipients.
    11. Persons registered as participants of the webinar receive an e-mail with a booking confirmation, an activation link to the meeting and the conditions of participation (i.e. the need to log in to the meeting in the browser, using the data provided during registration).
  6. NEWSLETTER
    1. Newsletter is a cyclical provision of information on IT solutions and topics covered on the Service Provider's websites, which may contain promotional and commercial information.
    2. The service is provided free of charge for an indefinite period (i.e. until the consent is withdrawn).
    3. Commercial information is considered to be ordered if the Service Recipient has agreed to receive such information (Newsletter), in particular, has provided an electronic address identifying him/her at the time of registration in the Service Provider's IT system for this purpose.
    4. Providing an e-mail address is necessary to use the "Newsletter" service. At the same time, it constitutes consent to receive commercial information from the Service Provider by means of electronic communication in accordance with art. 172 of the Act - Telecommunications Law and art. 10 of the Act on the provision of electronic services.
    5. The Service Recipient may at any time unsubscribe from receiving the Newsletter, with immediate effect, using the link contained in each e-mail being the "Newsletter" or informing the Service Provider about it in any other form - e.g. in writing, by phone, by e-mail to the following address: biuro@kbj.com.pl.
    6. The resignation referred to above is tantamount to termination of the contract for the provision of electronic services regarding the receipt of the Newsletter
  7. SERVICE RECIPIENT'S CONSENT TO DATA PROCESSING
    1. The Service Recipient is responsible for the correctness and timeliness of the personal data provided. In the event of justified doubts, the Service Provider has the right to demand rectification and documentation of the correctness of the data by the Service Recipient.
    2. The processing of personal data will take place on the terms set out in the Privacy Policy.
    3. The transfer of data and consent to their processing by the Service Recipient is always voluntary, but necessary to use the services provided electronically.
    4. Acceptance of these Regulations is understood as express consent to the processing of personal data provided at the time of launching the service provided electronically or placing an order via e-mail or contact forms on the Service Provider's website.
  8. COMPLAINT PROCEDURE
    1. Complaints regarding non-performance or improper performance of electronic services by the Service Provider may be submitted within 30 days from the date on which the service was or was to be performed, in writing to the address of the Service Provider's registered office or in electronic form by sending a request to the following address: biuro@kbj.com.pl.
    2. Wniosek o rozpatrzenie reklamacja powinna zawierać informacje i okoliczności dotyczących przedmiotu reklamacji oraz dane kontaktowe osoby składającej reklamację.
    3. The Service Provider considers applications immediately, no later than within 14 days from the date of their submission.
    4. In the event of a breach of the complaint procedure, the complaint may not be accepted.
  9. TRANSITIONAL AND FINAL PROVISIONS
    In matters not covered by these Regulations, the provisions of generally applicable law shall apply.
    The Service Provider reserves the right to make changes to the Regulations, in particular as a result of changes in the law to the extent that these changes affect the provisions and implementation of these Regulations.
